Powers of Attorney can be of the following types:
a. General Power of Attorney, or b. Special Power of Attorney.
In addition they above can either be:
a. Revocable (where the same is not coupled with an interest), or b. Irrevocable (where the same is coupled with an interest).
Registration of a power of attorney is mandatory where the same:
a. deals with transfer of possession in any immovable property. This is relevant in light of: (i) Sec.17 of the Registration Act, 1908, (ii) a full bench judgment of the Supreme Court of India in 2011, and (iii) relevant State laws in this regard; and
b. is to be done within four (4) months from the date of execution of the power of attorney. This in relevance to Sec.23 of the Registration Act, 1908.
